BSUG Audit Database GDPR compliance - Chairs' Update

 Dear Consultant member,

REMINDER 
 
As was discussed at the AGM Nov 2023, BSUG had received a letter from the GDPR team at an NHS Trust querying issues regarding the GDPR compliance of the BSUG database. In view of this query, BSUG has undertaken a GDPR review, with the help of a company that specialises in data protection, to ensure the database is GDPR compliant. 

BSUG previously had sent an email to members mentioning that such database changes will be effective from July 2024 however it could not be actioned owing to some delays in ensuring safe processing of the data, thanks for your patience with this.
 
To that end, as per the recommendation of the Data Protection Officer, it has been decided to retain Patient Identifiable Information for a period of 15 years from the date of last operation.  Of this, 10 years is the defined audit period and the additional 5 years is in line with the NHS code.  In other words, all data where date of operation was >/= 15 years ago will be anonymised.  This function will take effect from March 31st 2025.
 
You will still be able to use the anonymised data for audit purposes but not be able to identify the patients or add any further long term follow up / episodes in the same patient record.
 
In the meantime, if your centre would like to download the data and keep it within the Information Governance system of your trust, you can do so by making use of the Centre Manager function in the database.  If you don’t have someone designated to be Centre Manager at your centre, you could request for one by contacting Amanda King aking@rcog.org.uk
